Plaintiff Sues Toyota and its Driver Who he Claims Struck his Vehicle

A motorcyclist recently brought a lawsuit against Toyota and one of its drivers claiming the driver struck his vehicle. The incident reportedly occurred on July 19, 2013 when the male plaintiff, driving a 1982 Yamaha motorcycle, was traveling east on U.S. Route 40. According to court documents, the male defendant, driving for Toyota, was traveling north on Lake Road driving a 2011 E-250 Ford when he struck the plaintiff's motorcycle after failing to yield the right-of-way. As a result of the accident, the male plaintiff claims he suffered permanent and disabling injuries to his head, neck, back, chest, ribs, hips and legs and endured great physical pain and suffering. Beyond the physical pain, the male plaintiff also claims he incurred medical costs as a result of the accident. The plaintiff says the defendant is to blame for the accident and his resulting injuries because he failed to yield the right-of-way at an intersection, did not maintain a proper lookout, did not slow down or stop in an attempt to avoid the collision and drove so as to strike the side of the plaintiff's vehicle. The plaintiff, who seeks a judgment of more than $100,000, plus costs, filed the lawsuit on July 16 in the Madison County Circuit Court against Toyota Industries North America, Inc. and the individual driver.
