A man has recently filed suit against a driver who drove away while the man was reaching into the vehicle to care for his children who were passengers in the car. The incident that reportedly led to this lawsuit occurred on October 28, 2012 in Madison, Illinois when the plaintiff was reaching into the back of the defendant's vehicle. According to court documents, the vehicle was parked at 1318 Madison Ave. when the plaintiff attempted to attend to his children, who were sitting in the backseat of the defendant's vehicle. At the same time, the defendant pulled the vehicle forward. The relationship between the plaintiff and the defendant is unclear. The plaintiff claims that as a result of the incident, he sustained physical injuries, incurred medical costs, lost wages, suffered disfigurement and disability and was restricted in pursuing his usual activities. The male plaintiff blames the female defendant for the incident stating that she negligently failed to keep a proper lookout, allowed her vehicle to collide with him, drove too fast, failed to reduce her speed, failed to control her vehicle, drove in a careless manner and failed to warn him that she was leaving. The plaintiff, seeking a judgment of more than $200,000 plus costs, filed this lawsuit in the Madison County Circuit Court on August 15.
