Joan Rivers Medical Malpractice Case Settles

This month, a medical malpractice lawsuit involving the death of a popular female comedian was settled after a year long battle. The family of the deceased sued a New York City clinic in 2015 for medical malpractice for performing unauthorized medical procedures, taking selfies with the patient and failing to respond appropriately to the patient's deteriorating vital signs. The female comedian and star of a popular show, "Fashion Police" on E!”, was treated by a New York City clinic for a routine endoscopy. The woman died days after the procedure. Among many errors, the family claimed that doctors at the clinic had allegedly mishandled the woman’s' endoscopy and performed another procedure, known as a laryngoscopy, without consent. The lawsuit also claimed that an anesthesiologist’s concerns were ignored during the procedures.

The Federal Centers for Medicare and Medicaid Services investigation the death of the woman and found that the clinic had made several errors, including the failure to keep proper records of medications and taking photos with cell phones. The investigation also discovers that the clinic had failed to record the woman’s weight before administering sedation medication as well as failure to obtaining consent for all procedures performed.

The clinic has settled the medical malpractice lawsuit with the family for an undisclosed amount. The family’s attorneys announced they were pleased with the settlement and hope this will result in improved safety standards for outpatient surgical clinics and patient care.
