Gift Boxes Recalled Due to Mold

A product recall has been issued by Schurman Retail Group for their gift boxes. These particular products have been associated with about nine complaints of respiratory issues. These complaints have arisen as a result of the presence of mold on the gift boxes. The recall has been placed on around 8,400 boxes in the United States and two in Canada.

A variety of laws are in place in order to provide consumers with protection from faulty and dangerous products. As a consumer, it is necessary to know your rights so that you can defend yourself and seek legal representation if need be. When a company places a product in the stream of commerce certain warranties are implied or assumed to be effective between the seller and buyer. One such warranty is called the implied warranty of merchant ability, which states that products placed into the stream of commerce will be fit for the intended purpose. Implied warranties are inherent on a state-by-state basis, whereas express warranties are optionally granted by the seller. It is important to consider both implied warranties and express warranties when determining whether there is liability for a defective product.
