Plaintiff Sue Distracted Driver Over Rear-End Collision

Meyerkord, Meyerkord & Kurth, LLC: A Legacy of Legal Innovation

A driver and his passenger recently filed suit over injuries they sustained in a rear-end collision at Marissa intersection. The incident that led to this lawsuit reportedly occurred when the male driver was behind the wheel of a Pontiac G6 stopped at the intersection of Lyons Road and Pinckneyville Road. A female was a passenger in the car. According to court documents, a male, driving a Ford 500, in the same direction "became distracted and violently struck the rear" of the stopped Pontiac. The plaintiffs allege they sustained serious injuries as a result of the accident. Of course, the plaintiffs maintain that the male defendant is responsible for the incident, claiming he was negligent for failing to keep a proper lookout and failing to drive at a speed reasonable for conditions. Specifically, the plaintiffs claim they were "violently thrown" inside the car, causing injuries to their backs, necks and internal organs. The pair filed this lawsuit on August 26 in St. Clair County Circuit Court against the individual driver. The plaintiffs each ask for more than $50,000 for medical expenses, pain and mental anguish.
