A man recently filed a lawsuit in the St. Clair County Circuit Court against the driver who he alleges struck his car while he yielded to traffic. The incident that reportedly led to this lawsuit occurred when the male plaintiff was in the process of merging from Interstate Highway 255 onto eastbound Interstate Highway 64. The plaintiff alleges that, although he yielded to oncoming traffic while merging, the male defendant, who was in the vehicle directly behind the plaintiff, struck the rear-end of his vehicle. As a result of the accident, the male plaintiff alleged he suffered serious back, neck, head, arm and leg injuries. Furthermore, the plaintiff claims he endured great physical pain and mental anguish and suffered from an impaired bodily function, according to court documents. Also as a result of the accident, the plaintiff alleged he lost wages and lost his enjoyment of life. Of course, the plaintiff blames the male defendant for causing the collision, claiming he negligently drove too fast, failed to keep a proper lookout, failed to warn of his impending approach and collided with the back of the plaintiff's car. In the lawsuit, filed on August 26, the plaintiff asks for a judgment of more than $50,000, plus costs.
