A man recently filed a lawsuit in the St. Clair County Circuit Court against a man and his employer for allegedly running one tractor-trailer into the back of another. The incident that reportedly led to this lawsuit occurred on December 16, 2013 when the male plaintiff was driving an International Harvester semi-truck on U.S. Route 50 east. Simultaneously, the male defendant, also driving an International Harvester semi-truck owned by Natures Second Chance Hauling, ran into the back of the plaintiff's vehicle. As a result of the accident, the plaintiff claims he suffered permanent neurological injuries to his lumbar spine. The plaintiff cites negligence as the cause of action and alleges that the driver failed to control the tractor-trailer, drove too fast for conditions, followed too closely and failed to take necessary actions to avoid the collision. The driver's employer, Natures Second Chance Hauling, also named as a defendant in the lawsuit, is accused of negligence in that it failed to ensure the semi-truck was operated ina safe manner. The lawsuit was filed on August 29 against the individual driver and Natures Second Chance Hauling of Alton. The plaintiff seeks a judgment in excess of $150,000 in damages for medical expenses, lost wages, loss of earning capacity, loss of household services, pain, suffering and mental anguish.
