A $1.5 million New Jersey award was upheld, and $87,000 in medical expenses, in favor of a Utah woman even after an appeals court had previously overturned a $10.5 million verdict. The jury's award was upheld in light of the victim's development of a bowel disease after she used Hoffman La Roche Inc. and Roche Laboratories, Inc.'s Accutane acne medicine. The victim's suit was based on an allegation that the Roche defendants failed to properly warn her doctors that Accutane could cause ulcerative colitis. The victim took Accutane for six years and the medication failed to properly warn the victim about the risks that would occur on her colon.

Juries have previously found that the Roche defendants knew about the causal affects between the drug and the bowel disease and that they purposefully and wrongfully withheld the information from patients and their doctors. In fact, this is the ninth consecutive jury to find that the Roche defendants failed to warn patients that Accutance generally causes ulcerative colitis. Additionally, Accutance has also been linked to birth effects and depression. Since the drug went on the US market in 1982, about 16 million people have taken Accutance.
