Suit Brought Against Nursing Home for Resident's Death

Meyerkord & Kurth, LLC: A Legacy of Legal Innovation

A lawsuit recently filed against an Illinois nursing home alleges that the home is responsible for a former resident's death. According to court documents, the former resident died after falling at the nursing home. A relative of the deceased male filed a lawsuit on behalf of the deceased male's estate in the Madison County Circuit Court on June 5 against Alton Memorial Hospital, doing business as Alton Memorial Hospital Hatch Skilled Nursing. The complaint alleges that while the deceased male was living at the facility, he suffered a hip fracture and a subdural hemorrhage in December of 2013. Those injuries are said to have led to the man's death. The lawsuit says that Alton Memorial Hospital Hatch Skilled Nursing is responsible for the man's death. Specifically, court documents allege the nursing home's employees failed to assist and encourage the deceased male with his movements, failed to take precautions necessary to ensure that the male enjoyed an accident and hazard-free environment and failed to maintain a customized resident care plan tailored to the man's condition. As a result of the man's death, the lawsuit alleges his estate incurred medical costs. The suit prays for more than $100,000 in damages plus any other relief that the court deems just.

In many instances, nursing homes are understaffed, and the staff that is employed is overworked, poorly trained, or even blatantly unethical. Often, staff members will be hired without any kind of criminal background check beforehand. This creates conditions in the nursing home that are very conducive to the occurrence of neglect and injury to the residents.
