A Brooklyn jury recently awarded $5.465 million to a male plaintiff in a motor vehicle accident case. The accident that provoked the lawsuit occurred in August of 2010 in Red Hook at the intersection of Wolcott and Richards. The defendant, the driver of a mini school bus transporting 8 children, was stopped at the intersection. While stopped, the bus driver realized he had slightly passed the discharge point for one of his passengers where he should have stopped. As a result, the bus driver decided to reverse, causing the bus to ram into the plaintiff's 2008 Dodge Charger, which was behind the bus. None of the children on the bus were injured in the collision. The jury found that the defendant was 100 percent liable. The plaintiff alleged that he was suffering from cervical spinal injuries, which required surgery in the fall of 2013, as a result of the accident and testified that he had no prior medical history of pain symptoms. The lawyer for the defendant attempted to convince the jury that the 46-year-old, who worked as a truck driver for 15 years, had pre-existing injuries that were unrelated to any injuries sustained in the accident. However, the jury found for the plaintiff and awarded $3 million for past pain and suffering, $2 million for future pain and suffering, $350,000 for future medical expenses and $115,000 for past medical expenses.
