The day after Target announced that up to 40 million consumers' credit and debit cards had been compromised, a class action lawsuit was filed in federal court in East St. Louis. The suit was filed on December 19 on behalf of three plaintiffs from Millstadt, Mascoutah, and Florissant, Missouri. The three named plaintiffs seek to represent a class of all persons who have or will suffer similar damages. The much publicized announcement came on December 18 when the retailer announced that customer card information had been compromised between November 27 and December 15. Target cautioned that personal information collected during that period was used or was at risk of use in fraudulent transactions around the world. The lawsuit alleges that the retail giant failed to notify plaintiff and the putative classes in a timely manner as well as failed to take other reasonable steps to inform them of the nature and extent of the breach. This suit claims that plaintiffs and class members are entitled to a number of continuing damages, including financial monitoring to prevent or mitigate theft or fraud. Along with negligence and breach of implied contract, the complaint also alleged violations of the Federal Stored Information Act, the Missouri Merchandising Practices Act and the Illinois Personal Information Protection Act.
