Woman Files Suit Against Bayer Over Alleged Mirena Injuries

An Oklahoma woman has recently filed suit against a drug manufacturer alleging that she sustained injuries from a contraceptive device that the company produced. The suit was filed in St. Clair County, Illinois on January 30, 2014 against Bayer Healthcare Pharmaceuticals. Specifically, the woman alleges that the contraceptive device, Mirena, which was manufactured by Bayer, migrated within her body. After the device shifted from its proper position in her body, the device had to be removed, causing the woman injuries. The woman alleges that because of the device's migration, she suffered permanent injuries, endured physical pain and suffering and experienced mental pain. Additionally, the woman lost her enjoyment of life, incurred medical costs and lost her earnings and earning capacity, according to court documents. The suit names various causes of action including, design defect, negligence, failure to warn, breach of implied warranty, breach of express warranty, misrepresentation by omission, fraudulent misrepresentation and breach of implied warranty. The woman hopes to recover damages of more than $350,000, plus costs, attorneys' fees and other relief the court deems just.
