Woman Sues Charter Communications Over Trip and Fall

Meyerkord & Kurth, LLC: A Legacy of Legal Innovation

A woman who sprained her ankle when she fell on cable wires has recently filed suit against Charter Communications. The incident that led to this lawsuit reportedly occurred on April 30, 2013 when the female plaintiff tripped into the front driver side door and fell to the ground while walking to her car. According to court documents, the woman felt pain in her left ankle, arm, knee, lower back and buttocks immediately after the fall. The suit states that the woman was later diagnosed with a sprained ankle by doctors at an urgent care center. The incident occurred at 701 N. Main St. in Edwardsville where Charter's subcontractors, Ervin Cable construction and Mata Cable Construction, were performing cable work. The plaintiff alleges that the ground sunk in. In addition to her injury, the female plaintiff alleges she lost earnings and her normal life, incurred medical costs and has been restricted in her usual activities. The plaintiff blames the defendants stating that they negligently failed to warn of the dangerous premises, failed to safely maintain a workspace, failed to use reasonable care and failed to prevent pedestrians from falling on the uneven construction site. The plaintiff filed suit in the Madison County Circuit Court on August 16 against Charter and its subcontractors seeking a judgment of more than $150,000 plus costs.
