Metrolink Hits Pedestrian

Metrolink Hits Pedestrian

http://www.kmov.com/news/local/MetroLink-shut-down-in-part-of-west-St-Louis-after-person-is-hit-by-train-271339071.html

Last night someone was hit by a MetroLink train in St. Louis. The MetroLink shut down for about an hour to clear the area and respond to the person who was hit by the train. It is unclear if it was the fault of the MetroLink driver or the person who was hit. The area that was closed was in the Central West End, in between the Grand and Central West End stations. The section of train reopened around 1:00 AM on Friday morning. When medical responders arrived, the person who was hit was still breathing and conscious, but their current medical condition has not been disclosed.

Public places and common-carriers, like MetroLink, have a duty to be safe to the public. If the MetroLink driver was at fault, they would have breached a duty of care in their operation of the train. However, in the dark with proper safety precautions, it is still possible that the driver could have hit a pedestrian who jumped in front of the train, etc. More investigation would be required to determine who was at fault for the injury, and if the pedestrian could recover in a lawsuit.
