Wife Sues After Accident Causes Husband's Death

A 39-year-old toll way worker from Park Ridge, Illinois was killed on Interstate 88 while trying to help a disabled truck on January 27, 2014. The 39-year-old male initially parked behind the disabled truck on the east side of the interstate with his emergency lights on. However, moments later a 46-year-old truck driver from Hanover Park, slammed into the vehicles, critically injuring the 39-year-old. The wife of the 39-year-old, now widowed, has filed a wrongful death lawsuit against the 46-year-old truck driver and DND International, the company he was driving for. When large, commercial vehicles are involved in roadway accidents, the damage can be severe and fatalities are more likely. According to the Sun Times, the defendant-driver has been charged with "operating a commercial motor vehicle while impaired or fatigued, making a false report of a record and duty status, and driving beyond the 14- and 11-hour rules." The 46-year-old driver had been working for 37 hours with only about four hours of sleep, according to prosecutors. The defendant-driver was released after paying $15,000 bail on January 29, 2014. The wife and mother who brought this suit is seeking more than $50,000 in damages, alleging that the defendant-driver negligently operated his truck and should be held liable.
