Former Texas Police Officers in Hit and Run Lawsuit
A man who was injured by two off-duty police officers has filed suit against the former officers. At the time of the crash, Sgt. Chad Peabody and Detective Jason Montgomery were off-duty and riding in hteir personal car. According to the police report, the officers ran a red light and slammed into the victim's car. After the crash, the officers fled the scene of the accident, and the plaintiff believes these men were drunk at the time of the collision. Neither of these officers has been arrested in connection with this hit and run, but both resigned from the police department a few days after the crash. In the plaintiff's suit, he is demanding an excess of $100,000 for damages he sustained in the accident.
Although this case has a unique twist. It is essentially a motor vehicle accident. If the plaintiff's allegations are true then whichever police officer was driving the car is negligent, and that police officer must pay the plaintiff damages. An interesting question arises from this case. Is the passenger in the car liable for not assisting the other driver after the crash? Most jurisdictions hold that a person owes no duty to another unless certain exceptions apply. One of those exceptions is if the person places the victim in danger. Here, it is not known whether the passenger could have placed the victim in danger. Likely, this aspect will be litigated in this case.
