Woman Wins Suit against Michigan Hospital that Disfigured Her Daughter

A woman from Flint, Michigan has won a medical malpractice lawsuit against the Genesys Regional Medical Center. The woman brought suit after her child was seriously disfigured and lost the use of the child's left arm during the child's birth. A jury recently returned a verdict in favor of the woman in the amount of $12.9 million. The trial judge overseeing the case stated this was the largest verdict he has seen in over eight years. The plaintiff claimed that residents at the hospital pulled too hard on the baby's head during childbirth after the child got stuck in the birthing canal. The plaintiff claimed the residents should have done a caesarian section because the child's arm had got caught on the pelvic bone and doctors could not have safely removed the baby. The child is now five years-old and has undergone multiple surgeries and continues to wear a brace. The hospital is expected to appeal.

Michigan is like many states which caps the amount an injured person can recover from a tortfeasor. Here, the plaintiff's award will likely be reduced to $4 million once the statutory cap takes effect. These caps essentially pigeonhole our 7th Amendment right to a jury.
