In March 2009, a married couple and their 2-year-old daughter were leaving a Horse Expo at the Lancaster Event Center in Nebraska when a young mule kicked the 2-year-old, breaking her nose and eye socket. Several months later, the parents of the child sued. Specifically, they alleged the Horse Council failed to adequately warn spectators of the inherit risk of equine activities and also that it failed to maintain safe premises. By the time the parents filed suit, their daughter's medical bills had already exceeded $40,000 for her injuries, described as permanent and disabling. The House Council responded to the suit by claiming the parents had assumed the risk and thus shared in the negligence. Although the Lancaster County Agricultural Society was originally part of the suit, the party was dropped from it in 2010. Last week, the parents of the child asked a Lancaster County District Judge to dismiss the case. Although the court records did not include settlement details, a separate case filed in Lancaster County Court states the Horse Council and its insurer agreed to pay $92,500 to settle all disputes relating to the 2-year-old's injuries without admitting liability. The young girl's portion of the settlement is to be paid out each year on her birthday starting when she turns 19. The family declined comment.
