A jury in Lehigh County, Pennsylvania awarded a woman and her daughter $4 million after finding an Allentown obstetrician’s negligence caused permanent injuries to the pair. According to court documents, the doctor failed to perform a cesarean section and continued with natural delivery after the woman’s labor stalled in August 2009. As a result, the woman’s child, now 4, suffers from cerebral palsy and neurological injuries. Additionally, the mother suffered injuries that rendered her incontinent and unable to work according to court documents. The verdict came after a four-day trial where the woman’s lawyers presented evidence that the doctor ignored signs indicating a cesarean delivery should have been performed. According to court papers, the woman had an ultrasound days before she went into labor that showed the baby weighed around 10 lbs. The doctor reassured the mother that there was nothing to worry about. Furthermore, the doctor proceeded with natural delivery after the woman’s labor stopped progressing for nearly 8 hours—a sign that should have indicated a cesarean delivery was safer, according to an expert witness. The doctor was forced to use forceps to assist the woman after she became too tired to continue pushing. During delivery, the baby was deprived of oxygen for 3 ½ minutes after the baby’s shoulder became stuck on her mother’s pelvis. The baby had to undergo surgery the same day and ultimately spent 2 months in the hospital.
