Kia Motors Defective Automotive Class Action Lawsuit Filed

A defective automotive class action lawsuit was recently brought against Kia Motors alleging that the defective fuel tank placements in some of its vehicles put passengers at risk of serious injury or death in the event of collision. The suit, filed on November 13, 2013 in California federal court, alleges that the company falsely misrepresented some of its vehicles as being constructed with "world-class quality." Specifically, the suit alleges that the design of certain Kia vehicles, including the 2010 through 2013 Kia Soul, have the gas tank placed directly under the rear seat. And unlike a common industry practice, there are no means of protecting or reinforcing the fuel tank with straps or a shield. Thus, the suit alleges that the design "increases the risk that the gas tank will dislodge and ignite in a major collision." The complaint goes on to say that because the plastic fuel pump cover is placed directly under the rear seat cushion, if the gas tank were to become dislodged, the design increases the likelihood of a "blow torch fire in the rear compartment." This allegedly did occur in Texas when a Kia Soul exploded in a collision as a result of the defective gas tank design. The lawsuit states that all three passengers in the rear compartment burned to death. The plaintiffs in this case are seeking to represent anyone who purchased, leased or currently owns or leases a Kia vehicle model that has the same defect.
