A woman was awarded over $100,000 after a jury found that a prominent gynecologist committed malpractice when he removed a healthy ovary and left a piece of plastic in the woman's body after a 2007 robotic surgery. The jury of four woman and three men found for the woman and her husband this past Thursday after hearing two days of testimony from the plaintiffs and seven physicians, including the defendant physician. The couple, seeking nearly $1 million in damages, was awarded more than $10,500 in medical expenses and $100,000 as compensation for physical pain and mental anguish. According to hospital records, the defendant physician used a da Vinci robotic device, a product that has been the subject of much litigation, which malfunctioned in the woman's September 28, 2007 surgery. Three years after the surgery, the woman found out for the first time through a CT scan that foreign objects were left in her body, including a laparoscopy sheath and extraneous coils used as birth-control devices. The woman consented to the surgical removal of her right ovary and fallopian tube, as well as her appendix, after suffering pelvic pain prior to the 2007 robotic surgery. However, after the surgery the organs were deemed normal and functioning.
