Runaway Elevator Causes Injury to Two People

Leslie Williams and Victoria Martinez have filed a claim against Chevron U.S.A., Inc. The suit claims the two were injured in an elevator at the company's downtown Houston offices. According to the suit, the elevator malfunctioned on the 39th floor. The two occupants were trapped on that floor for nearly an hour and were in contact with security through the elevator's intercom. Suddenly the elevator shot upward and crashed into the top floor. Firefighters eventually rescued the women by dropping a ladder down from the roof of the building and having the women climb out. The suit claims the women suffered a broken foot, back injuries, head trauma, and emotional distress. The plaintiffs originally filed this action in state court, but the defendant moved it to federal court citing law which supported the notion that federal court was the appropriate court.

This suit against Chevron is based on a theory of premise liability. Premise liability is when a guest or invitee is injured while on the premise of an owner. State law varies but normally the owner of the premise has to have knowledge or reasonably should have had knowledge a dangerous condition exists before liability can exist. However, each state sets its own standards for negligence, and that is why it is important to speak with an attorney who is knowledgeable in the jurisdiction where the injury occurred.

Premises liability and safety of patrons of a business or public place plays an important role in our society. It is paramount to determine who bears the responsibility of an unsafe condition of a public place.
