Medical Company Enticed Doctors and Hospitals to Purchase Radiation Treatment with Illegal Payments

C.R. Bard Inc. is being required to pay $48 million to settle allegations that it made illegal payments to hospitals and doctors in order to get them to purchase radiation treatment for prostate cancer. These illegal payments took place between 1998 and 2006 and were in the form of rebates, conference fees, and free medical equipment. Over $10 million will go to a former executive at the company turned whistleblower according to the Department of Justice, and the company will have to pay an additional $2 million to the government. This entire settlement keeps the Department of Justice from prosecuting the company.

This settlement illustrates the line which has been blurred between hospitals, doctors, and medical companies. In this case, C.R. Bard sold hospitals machines illegally, and according to the suit the hospitals illegally billed Medicare when treatments were done on the machines. Therefore, a patient received this care which might have been less effective, and this patient may have suffered as a result. Patients should take a proactive role in their care and question hospitals and doctors every step of the way. This is a patient's right. If a doctor or hospital fails to provide a satisfactory answer for a procedure, the patient should go to another doctor or hospital for a second opinion.
