Earlier this month, a woman filed suit alleging her doctor failed to offer a C-section. This failure caused the woman to suffer severe pain from tearing during the birth of her child, according to the lawsuit. According to the complaint, filed December 5, 2013 in Madison County Circuit Court, the woman gave birth to her child on January 19, 2012. During the birth, the woman alleges she suffered a third-degree extension tear after her doctor failed to offer a C-section. The suit goes on to say that because of the incident, the woman has continued to experience pain and suffering; sustained mental anguish, disfigurement and disability; and lost her enjoyment of life. The woman asserts blame to her doctor for contributing to her injuries by failing to inform her of the possibility of complications of vaginal delivery along with failing to provide her with the option to opt for a C-section. The woman also named Distinctive Care for Woman as a defendant, asserting liability for her injuries because it hired the doctor who delivered her child. The woman is seeking a judgment of more than $200,000 plus costs.
