Lawsuit Filed over Shampoos Containing Carcinogens
The Center for Environmental Health, an Oakland, California, watchdog group has filed suit against several companies alleging these companies are manufacturing or selling shampoos or soaps with high levels of carcinogens. The defendants in the suit include Walgreens, Vogue International, and Ultimark Products. The Center for Environmental Health has stated it plans to sue others in the industry over this practice. Last year a California regulation came out requiring manufacturers and sellers of shampoos with cocamide DEA to place a warning label on the products. This carcinogens is used to make bubbles in the products, and the suit claims the various manufacturers and sellers failed to label these products properly. A spokesman for the Center for Environmental Health stated that there are many way to make these products without the use of harmful carcinogens, and this suit is designed at eliminating such carcinogens from consumers' daily use.
Manufacturers and sellers of goods have a duty to ensure their goods are reasonably safe for use. The definition of reasonably safe can be based on a state's common law or statutory authority. Here, California has come out requiring manufacturers to at least warn consumers of the presence of this particular carcinogen, and if the allegations are true, manufacturers and sellers have failed to follow this requirement.
