Firefighters File Suit against Siren Manufacturers

http://www.post-gazette.com/stories/local/neighborhoods-city/city-firefighters-sue-over-siren-hearing-loss-684645/

Four firefighters have filed suit against several manufacturers alleging the sirens used on their fire trucks have caused the firefighters irreversible hearing loss. Three of the firefighters have worked for the city of Pitttsburgh for over 30 years. One firefighter has worked for the department for over 10 years. The complaint names American Lafrance, E-One Inc., Kovatch Mobile Equipment Corp., Mack Trucks Inc., and several other manufacturers. The suit claims the trucks the firefighters used did not have proper insulation to prevent the firefighters from sustaining hearing loss. The complaint claims the manufacturers of the siren failed to warn of the risks associated with being around the sirens. The suit does not name the city of Pittsburgh, and a spokesman for the city declined to comment on the suit.

The firefighters in this case have initiated a products liability action against those who manufacturer their equipment. The facts of this case have not been fully fleshed out, but the firefighters may have a claim if they were never given warning of the dangers of the sirens and the lack of insulation in the truck. Likely, the firefighters did not file suit against the city because the city has immunity from suit. However, this does not mean the city is not liable. It simply means the firefighters could not recover from the city.
