Meyerkord & Kurth Seeks Justice After Fatal Accident Claims Highway Construction Worker's Life

Meyerkord & Kurth is currently representing the family of a man who was struck and killed by a dump truck while working on a jobsite in Ste. Genevieve County.

It was around 10:45 am on Monday, July 2, 2012 when Larry Dye, a 31-year-old highway construction worker, lost his life while working on Interstate 55. As he picked up a highway sign and then attempted to cross the southbound lanes of the I-55, he was struck by a dump truck that was backing up. The truck was carrying a load of asphalt, backing up in a northbound direction in preparation of loading the asphalt into a paving machine when it struck Dye. The tragic incident occurred near mile marker 158 outside Bloomsdale, Missouri.

According to the Missouri State Highway Patrol, the dump truck was not travelling at a high rate of speed at the time of the accident. When the truck collided with Dye, however, the driver continued to back up. It is not clear whether the driver of the dump truck saw Dye. The Highway Patrol have initially categorized the incident as an accident and said that criminal charges will likely not be pursued.

Construction and transportation are two of the most dangerous fields, in terms of serious injuries and fatal accidents. This incident is proof of that. Larry Dye lost his life, and whether it can be attributed to carelessness or wrongdoing, his family has been left without. Our goal in handling cases such as this is to identify any and all potential sources of financial relief. A workers' compensation claim may cover fatal on-the-job injuries, and if a third party was involved, a wrongful death lawsuit may be filed against that individual or company.

There is no amount of money that could possibly compensate a family for the loss of a loved one. Financial compensation can, however, help the family with unexpected medical and funeral expenses and can help them face a more stable future without the support of their spouse, parent or other loved one. Finding the responsible parties and bringing them to justice can also bring families much-needed peace of mind. A sense of closure can also be obtained when the cause of the incident is known.

With compassion and tenacity, we seek justice for the injured and families of those who have lost their lives in preventable accidents such as the one that claimed Larry Dye's life. We are a father and son team that represents clients in St. Louis and throughout the surrounding areas in Missouri.
