Woman Sues Doctor After Unwanted Pregnancy

|

A Michigan woman is suing her doctor for medical malpractice after a wrongful conception occurred after a permanent birth control procedure. The woman underwent a permanent birth control procedure in 2008. The doctor found her fallopian tubes blocked and told her she could not get pregnant and she did not need contraceptives. The 50-year-old woman gave birth to a daughter in 2011 who has Down Syndrome. While the mother is deeply in love with her daughter, she argues that the unplanned pregnancy caused her emotional distress and a financial burden of raising a special needs child. The woman worries that she will not be able to take care of her child for the long term, worried her daughter will far outlive her due to having her at such a late age. The lawsuit claims the doctor allegedly misguided the woman with incorrect information and she would have made different choices, such as using contraceptives. The case will go to trial so a jury can decide of the doctor should be held responsible.
