West Virginia City Being Sued for Pedestrian Accident

Posted By Meyerkord & Meyerkord, LLC || 23-Jan-2017

The city of Marietta, West Virginia is being sued by a victim of a bicycle accident that occurred last June when she sustained five broken ribs and a punctured lung. The victim alleges her accident happened when she rode her bike on a downhill grade that had an inflated water hose on the path. She claims that there was no warning alerting pedestrians of the potential danger. The water hose was placed across the bike path when city workers were using it to wash a levee. The victim is not seeking a specific monetary amount, and a pre-trial date has not been set.

Pedestrian accidents send thousands of people to E.R. rooms each year with minor to severe injuries. The most frequent source of injury is due to uneven or cracked sidewalks. However, injuries can happen due to vehicles, holes in sidewalks or roads, falls and even dangerous weather conditions such as ice. Pedestrians who utilize public sidewalks, bike paths and roads should always remain alert in case there are issues with the surface. Anyone who is working or obstructing pedestrian paths should properly alert them of possible hazards to avoid injuries. Always contact your park or city department to let them know of any issues to sidewalks, paths, and roads. Injuries can mean expensive medical bills so always contact a personal injury attorney to discuss your legal options. An attorney will investigate your injuries and can determine if you have legal grounds to pursue compensation from those responsible for your injuries.
