Family of Car Crash Victim Awarded under $600,000 in Arbitration Against MoDOT

Brian Kurth of Meyerkord and Meyerkord LLC represented the family of a woman who was killed in an automobile accident. The accident occurred in 2005 when Carlyn Perkins drove into a large pool of water which accumulated on a roadway owned by the the city of St. Louis but maintained by MoDOT. The Missouri Highway & Transportation Commission (MHTC) was in charge of maintaining the roadways in that area, specifically to "maintain the surface of the roadway from curb to curb." Moreover in 2005, MoDOT placed work orders for the area in which Ms. Perkins was killed specifically for the purpose of warning drivers of dangerous conditions from water or ice. The order asked for a sign to be placed near the area Ms. Perkins was killed stating "Road Subject To Flooding." However, the work order was not fulfilled, and this provided evidence to MHTC's knowledge of the dangerous condition. Additionally, the city and state had knowledge of previously incidents related to water build up.

Arbitrators were brought in to resolve the dispute between the family of Ms. Perkins and MHTC. Those arbitrators decided that the total damage to Ms. Perkins was over one million dollars, and after deducting Ms. Perkins comparative fault, the total was diminished to just over six hundred thousand. Because of statutory limitation on the damages, Ms. Perkins' family will only receive around four hundred thousand dollars from MoDOT. Prior to this award the city of St. Louis settled with the family for two hundred and fifty thousand dollars bringing the total recovery to six hundred and fifty thousand dollars.
