A 10 year-old girl in Maine received a 6-3 jury verdict in her favor in a medical malpractice case against the midwife that attended her birth. However, the jury rejected the mother's claim that she could not function due to her mental illness that manifested following her daughter's birth and the institutional claim against the hospital. The jury denied the argument that the hospital represented the midwife as one of their agents and therefore did not assess damages against the hospital. The lawsuit is the second against the midwife; in 2007, a baby delivered by the midwife was diagnosed with cerebral palsy after delivery due to the loss of oxygen to the brain during delivery. The lawsuit netted the family of the boy $6.71 million.
