Missouri Consumer Protection

Missouri Consumers deserve protection from unscrupulous businesses and their deceptive schemes. The Missouri Legislature realized that consumers were often left with no legal remedies against businesses who have acted deceptively which was not strictly speaking, illegal. In response to this problem, the Legislature enacted the Missouri Merchandising Practices Act (MMPA). This statute provides protection for any person who is the victim deception, fraud, false pretenses, false promises, misrepresentation, unfair practices or the concealment, suppression, or omission of any important facts in connection with the sale or advertisement of any merchandise. Under this law, "Any person who purchases or leases merchandise primarily for personal, family or household purposes and thereby suffers an ascertainable loss of money or property, real or personal, as a result of the use or employment by another person of a method, act or practice declared unlawful by §407.020, may bring a private civil suit to recover actual damages." The MMPA is designed to preserve fundamental honest, fair play, and right dealings in public transactions. Raster, et al, v. Ameristar Casinos, Inc., 280 S.W.3d 120, 125-31 (Mo.App.E.D. 2009
